Notice of Data we Collect and How We Use It
We collect two types of data about individuals: (1) technical data automatically collected from all visitors to the Website, and individuals that use of our services (“Passive Data Collection”) and (2) information that you or others voluntarily submit to us (“User-Submitted Information”).
Passive Data Collection
We automatically track certain information based upon your behavior on the Website. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve you and our community.
Like most websites, we automatically receive and record certain information about our users’ behavior on our Website and when using our Services. The services we use to support our site automatically gather technical information about our Website traffic and store it in log files. We aggregate this information with other pieces of information to analyze trends, to administer and improve the Services, to track users’ movements around the Website and to make inventory purchasing decisions that will best serve our customer base. Pages of the Website may also use devices that permit us to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
User Submitted Information
If you order a product from us, we request certain Personal Information from you at checkout. You must provide contact information (including name, email address, telephone number) and financial information (including credit card number and expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. Before your order can be processed, we will require that you review and consent to our Terms and Conditions.
Our Technology Services
Our store is hosted on Shopify and uses BookThatApp for rentals. All User Submitted Information is stored within Shopify or BookThatApp’s databases.
Payment is processed via Stripe. All payment information, such as credit card information, is saved within Stripe’s platform. Shopify is certified as a PCI DSS Level 1 compliant service provider, which is the highest level of compliance available, and their platform is audited annually by a third-party qualified security assessor.
We also use sites such as Google Analytics to collect the Passive Data, which provides us insights into user behavior on our site and consumer preferences. We use this information to create the best possible experience for our customers.Consent
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at email@example.com.
As required by Law / Certain Business Transactions
We may disclose Personal Information if we have a good-faith belief that doing so is required by a subpoena or other judicial or administrative order or otherwise required by law or in connection with an actual or proposed corporate transaction or insolvency proceeding involving all or part of the business or asset to which the information pertains. This may include responding to legal requests from jurisdictions outside of the United States, where we have a good faith belief that the response is required by law in that jurisdiction.
To Protect Rights
Additionally, we may disclose Personal Information where we, in good faith, deem it appropriate or necessary to prevent violation of the Terms and Conditions, Rental Agreement, or our other agreements; take precautions against liability; protect the rights, property, or safety of Foryst LLC, any individual, or the general public; maintain and protect the security and integrity of our Services or infrastructure; protect ourselves and our Services from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against third-party claims or allegations; or assist government enforcement agencies.
Personal information is retained for as long as the account is active otherwise for a limited period of time as long as it is needed to fulfill the purposes for which it was collected, unless otherwise required by law. Foryst LLC will retain and use information as necessary to comply with legal obligations, resolve disputes, and enforce agreements for a period of 7 years.
In general, the third-party providers used by Foryst will only collect, use and disclose your information to the extent necessary to allow them to perform their services.
However, certain third-party service providers, such as Shopify, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. This means that if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
To protect your personal information, Foryst LLC takes reasonable precautions and follows industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Access to Personally Identifiable Information

Age of Consent
You must be 18 years or older to use the services of Foryst LLC in any manner. By using our services and accepting the Terms and Conditions, you represent and warrant to the Company that you are 18 years of age or older, and that you have the right, authority, and capacity to agree to and abide by these terms. If you are under 18, you may only use this site while under the supervision of a parent or guardian. If at any time we are notified that we have personal information of someone under 18, we will delete that information.
